Return Authorization

It is about authorizing the departure and subsequent return to the national territory to the foreigner whose residence or stay authorization is in a period of renewal or extension.

a) Be the holder of a residence or stay authorization and have initiated the procedures for the renewal or extension of the authorization that enables you to remain in Spain within the legal term.
b) Be a valid foreigner identity card holder and have submitted a request for a duplicate card due to theft, loss, destruction or disablement.
c) Prove that the trip responds to a situation of need and exceptional reasons concur and have the initial authorization of residence or stay resolved favorably and have the issuance of the foreigner identity card in process.

A return authorization may not be granted to foreigners who are subject to a ban on leaving Spain or a limitation to their freedom of movement agreed upon by the Judicial Authority on a precautionary basis or in an extradition process, or as a result of a final judgment.

Note: in general, copies of the documents must be provided and the originals must be displayed at the time of submitting the application.


  • Application form in official form (EX-13) in duplicate, duly completed and signed by the foreigner. Said form can be obtained at
  • Copy of the complete passport or registration card and valid travel title.
  • Copy of the request for renewal or extension of the authorization or the foreigner identity card, or proof of presentation.
  • In case c) (have granted initial residence or stay authorization and have the foreigner identity card in process): documentation proving that the trip responds to a situation of need and exceptional circumstances concur.


Important note: when documents are provided from other countries must be translated into Spanish or the co-official language of the territory where the application is submitted.
On the other hand, all foreign public document must be previously legalized by the Consular Office of Spain with jurisdiction in the country in which said document has been issued or, where appropriate, by the Ministry of Foreign Affairs and Cooperation except in the case in which said document has been apostilled by the competent authority of the issuing country according to the Hague Convention of October 5, 1961 and unless said document is exempt from legalization by virtue of the International Convention.

Subject entitled to present the application: the foreigner personally, or by representation.
Place of presentation: any public registry and directed to the Immigration Office or the Police Station corresponding to the province in which the foreigner has a fixed address. The fees for processing the return authorization: they must always be paid prior to the issuance of the return authorization. They are accrued at the time of admission to processing of the application, and must be paid within ten business days, they are:
Model 790 code 052 if processed at the Immigration Office, or Model 790 code 012 if processed at the Police Station

The return authorization will always be delivered to the foreign citizen who is the recipient of the document, except in two cases:
Minor age or disability of the foreigner in whom the return authorization may be collected by his legal representative.
Occurrence abroad of an accredited impossibility of personal appearance (due to illness or transitory physical handicap accredited you by means of a medical certificate or hospital report signed by a registered doctor); in this case, you may go to a power of attorney of representation.

The return authorization will be valid for no more than 90 days:

  • If the residence or stay authorization is not in the renewal period, from the grant date.

If the residence or stay authorization is in the renewal period:

  • From the expiration date of the authorization, if requested before it expires.
  • From the grant date, if requested after the expiration of the authorization.

The return authorization may be used for all departures and subsequent return that are required during the validity of the authorization.
